EU right of withdrawal

The right of withdrawal lets a consumer in the EU withdraw from certain contracts made online within 14 days, without giving a reason. In Ireland it comes from Part 5 of the Consumer Rights Act 2022, which implements the EU Consumer Rights Directive (2011/83/EU).

Which are you?

  • A restaurant or food business subscribing to Easy Fuud — the right of withdrawal does not apply to you, because it is a right for consumers and you are contracting as a business. Read why, and what you have instead.
  • Someone ordering food from a restaurant that uses Easy Fuud — you are a consumer, but food orders are specifically carved out of the withdrawal right. Read what applies to your order.

If you subscribe to Easy Fuud as a business

Under section 2 of the Consumer Rights Act 2022 a "consumer" is a natural person acting for purposes outside their trade, business, craft or profession. A restaurant subscribing to run its business is acting inside its trade, so it is a trader, not a consumer.

The 14-day withdrawal right, and the other rights reserved to consumers in Part 5 of that Act, therefore do not apply to an Easy Fuud platform subscription. You confirm your business status expressly when you subscribe.

What you have instead

  • A free Starter plan and a free trial, so you can evaluate the product properly before paying anything.
  • Cancel anytime — no notice period, no cancellation fee, self-serve from your dashboard.
  • Your plan runs to the end of the month you have paid for, so cancelling never wastes money you have already spent.
  • Refunds for duplicate charges, charges after cancellation, amounts charged in error, and periods where we materially failed to provide the service.

If you believe you signed up as a consumer rather than as a business, email support@easyfuud.com. We apply whatever statutory rights actually apply to you, regardless of what our policy says.

If you ordered food through an Easy Fuud page

Who your contract is with. Easy Fuud is the software the restaurant uses. Your contract for the food is with the restaurant, not with Easy Fuud. Cancellations, refunds and complaints about an order go to the restaurant in the first instance.

Why the 14-day right doesn't apply to a food order. The Consumer Rights Act 2022 and the Consumer Rights Directive both carve certain contracts out of the withdrawal right. Two of those carve-outs cover ordinary food orders:

  • Goods that deteriorate or expire rapidly — prepared food and drink.
  • Services connected with catering where the contract provides for performance on a specific date or period — a meal for collection or delivery at a given time.

So you cannot withdraw from a food order simply because you changed your mind, and this is the case on any ordering platform, not just ours.

What you can do

  • Before the restaurant accepts your order — ask the restaurant to cancel it. Contact details are on the restaurant's ordering page.
  • After acceptance — cancellation is at the restaurant's discretion, since preparation may already have started.
  • If the order never arrived, arrived incomplete, or wasn't what was ordered — you keep your full statutory rights against the restaurant to a repeat performance, a price reduction or a refund. Contact the restaurant first; if you get nowhere, email support@easyfuud.com and we will help you reach them, and can assist with a refund through the payment provider where the restaurant confirms one or where there was a clear platform error.
  • If you were charged incorrectly — tell us. Billing errors are always put right.

Your other consumer rights — to food that matches its description, to accurate allergen information, and to protection against unfair terms — are unaffected by anything on this page.

Customer accounts

Registering a free customer account on Easy Fuud costs nothing and creates no payment obligation, so there is nothing to withdraw from. You can delete your account at any time from your account settings, or by emailing support@easyfuud.com. Deleting your account does not cancel an order already placed with a restaurant — contact the restaurant for that.
