1. About Easy Fuud
Easy Fuud ("Platform", "Service", "we", "us") is an online food ordering platform operated in Ireland. We enable customers to browse restaurant menus, place orders, and pay online or at the point of delivery. We also provide restaurants with a management dashboard to receive and process orders.
Easy Fuud operates as a technology intermediary. The contract for the supply of food and beverages is formed between the customer and the restaurant, not between the customer and Easy Fuud.
2. Acceptance of Terms
By accessing or using Easy Fuud, you confirm that you are at least 18 years of age and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Platform. These terms constitute a legally binding agreement under Irish law.
3. User Accounts
To place orders or manage a restaurant on Easy Fuud, you must register an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information. Easy Fuud reserves the right to suspend or terminate accounts where information is found to be inaccurate or misleading.
4. Orders and Payments
Placing an order through Easy Fuud constitutes an offer to purchase from the restaurant. Acceptance occurs when the restaurant confirms the order. Easy Fuud is not a party to this contract and accepts no liability for the quality, safety, or delivery of food orders.
Online payments are processed securely by Stripe (Stripe Payments Europe, Ltd, registered in Ireland). Card details are never stored by Easy Fuud. By paying online, you agree to Stripe's Terms of Service available at stripe.com/ie/legal.
All prices displayed are inclusive of applicable VAT where required. Restaurant platform subscription fees are subject to Irish VAT at the standard rate (23%) and are charged in Euros (€).
For cash or card-at-counter orders, payment is made directly to the restaurant at the time of delivery or collection.
5. Platform Subscription (Restaurants)
Restaurants subscribing to a paid plan on Easy Fuud agree to the following:
- Subscriptions are billed monthly in advance by Stripe and renew automatically unless cancelled.
- All subscription fees are stated in Euros and are subject to Irish VAT at 23%.
- You may cancel your subscription at any time via the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period.
- Easy Fuud reserves the right to suspend access to the platform where subscription payments are overdue.
- Refunds of subscription fees are at the sole discretion of Easy Fuud and will generally only be issued in cases of billing error.
6. VAT and Tax
Easy Fuud is a service provided from Ireland. Restaurant subscription fees are subject to Irish Value Added Tax (VAT) at the standard rate of 23% in accordance with the Value-Added Tax Consolidation Act 2010 and applicable EU VAT Directives.
VAT receipts are issued automatically for each subscription payment and are available in your dashboard under Billing & Invoices. Restaurants registered for VAT in Ireland or the EU may apply their VAT registration number to receive invoices with the reverse charge mechanism applied where applicable.
Food and beverage transactions between customers and restaurants are subject to the applicable VAT rate set by each restaurant in accordance with Revenue Commissioners guidance (currently 9% reduced rate for hot food and non-alcoholic beverages supplied in Ireland).
7. Restaurant Obligations
Restaurants using Easy Fuud agree to: provide accurate menu information and pricing inclusive of all applicable taxes; fulfil accepted orders promptly; maintain appropriate food hygiene standards in accordance with Irish and EU food safety regulations; hold all required food business registrations and licences; and keep their availability status up to date on the platform.
8. Cancellations and Refunds
Once an order is accepted by a restaurant, cancellation is at the restaurant's discretion. For disputes regarding order quality or non-delivery, customers should contact the restaurant in the first instance. Easy Fuud may facilitate refunds through Stripe where a restaurant confirms a cancellation or where there is a clear platform error.
Under the Consumer Rights Act 2022 (Ireland) and EU Consumer Rights Directive, distance-selling cancellation rights do not apply to food and beverage orders that have begun preparation.
9. Prohibited Use
You must not use Easy Fuud to: submit false or fraudulent orders; use another person's payment details without authorisation; attempt to circumvent platform security or authentication; scrape or harvest data; use the platform for any unlawful purpose; or in any way that breaches applicable Irish or EU law.
10. Intellectual Property
All content, trademarks, design, and code comprising the Easy Fuud platform are owned by or licensed to Easy Fuud. You may not reproduce, distribute, or create derivative works from any part of the platform without prior written permission.
11. Limitation of Liability
To the maximum extent permitted by Irish law, Easy Fuud's total liability to you for any claim arising from use of the platform shall not exceed the subscription fees paid by you in the 12 months preceding the claim. Easy Fuud shall not be liable for any indirect, incidental, or consequential loss including loss of profits, revenue, or data.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.
12. Changes to Terms
We may update these terms from time to time. Where changes are material, we will notify registered users by email at least 14 days before the changes take effect. Continued use of the platform after that date constitutes acceptance of the revised terms.
13. Governing Law and Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Irish courts. If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in your country of residence under applicable EU consumer protection law.
